Terms of Service

1. Introduction

Welcome to SkyFeed. These Terms of Service ("Terms") govern your access to and use of SkyFeed (skyfeed.app and skyfeed.eu), a feed builder for Bluesky and the ATmosphere (AT Protocol ecosystem), operated by Feedy UG (haftungsbeschränkt), registered at the Amtsgericht Darmstadt under HRB 107801, located at Holzhofallee 21, 64295 Darmstadt, Germany ("we", "us", "our").

By accessing or using SkyFeed, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the service.

2. Description of Service

SkyFeed is a feed building tool for the ATmosphere (AT Protocol ecosystem). It allows you to create, customize, and publish feed algorithms using a visual, block-based editor.

SkyFeed is not a social media platform. We do not host, store, or serve social media content. We do not operate timelines, recommend content, rank posts, or curate speech. All post content is retrieved in real time from the AT Protocol network. SkyFeed processes feed rules and logic only.

SkyFeed provides:

• A visual, block-based feed builder for creating custom feeds on Bluesky and the ATmosphere
• Feed serving infrastructure that executes your feed logic and delivers results via the AT Protocol feed generator framework

We may modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes.

3. Eligibility

You must be at least 18 years old to use SkyFeed. By using the service, you represent and warrant that you meet this age requirement. If you are under 18, you may not create an account or use SkyFeed.

4. Account & Authentication

SkyFeed uses Bluesky's authentication system (AT Protocol OAuth). When you sign in, you authorize SkyFeed to access your Bluesky account (via your PDS) on your behalf. You are responsible for:

• Maintaining the security of your Bluesky account credentials
• All activity that occurs through your authenticated session
• Promptly notifying us if you believe your account has been compromised

We do not store your Bluesky password. Authentication is handled through secure token-based mechanisms.

5. SkyFeed Pro Subscription

5.1 Subscription Plans

SkyFeed offers a free tier and a paid subscription ("SkyFeed Pro"). The free tier includes all current feed builder features and will remain free. SkyFeed Pro provides additional features such as real-time feed updates, faster feed refresh rates, and future premium capabilities.

5.2 Payment Processing

All payments for SkyFeed Pro are processed by Armitage Labs OÜ ("Creem"), based in Estonia (EU), which acts as our Merchant of Record. This means that Creem is the legal seller of SkyFeed Pro subscriptions. When you purchase a subscription, you enter into a separate agreement with Creem, and Creem's terms of service and privacy policy apply to the payment transaction.

Creem handles all billing, invoicing, sales tax, and VAT on our behalf. Your payment information is collected and processed exclusively by Creem. We never see or store your credit card details or other payment credentials.

5.3 Pricing & Billing

SkyFeed Pro is billed at the price displayed at the time of purchase. Prices may include applicable taxes as determined by Creem. We reserve the right to change subscription pricing with reasonable advance notice. Any price change will take effect at the start of your next billing period.

5.4 Cancellation

You may cancel your SkyFeed Pro subscription at any time. Upon cancellation:

• You will retain access to SkyFeed Pro features until the end of your current billing period
• Your subscription will not renew at the end of the current period
• You will not be charged again after cancellation
• Your account will revert to the free tier when the billing period ends

5.5 Refund Policy

Due to the digital nature of SkyFeed Pro, we generally do not offer refunds for subscription payments already made. When you cancel, you keep access until the end of your paid period.

If you believe there are exceptional circumstances warranting a refund, please contact us at contact@skyfeed.dev. We will review requests on a case-by-case basis and do our best to find a fair resolution.

Your statutory rights under applicable consumer protection laws remain unaffected.

5.6 Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you may have a statutory 14-day right of withdrawal for online purchases. When you complete a purchase through Creem's checkout, you may be asked to consent to the immediate provision of the digital service and to acknowledge that this waives your right of withdrawal. The terms and process for any withdrawal right are governed by Creem's terms as the Merchant of Record.

6. User Content & Feeds

Your feed definitions are stored on the AT Protocol network (typically on your Personal Data Server / PDS), not on SkyFeed's infrastructure. We do not claim any ownership of your content, feeds, or data. You retain full ownership and control of your feed configurations and creative choices at all times.

SkyFeed's role is to execute your feed logic and serve the results to users who subscribe to your feed. If you stop using SkyFeed or we stop operating, your feed definitions remain on the AT Protocol network under your control.

Important: The AT Protocol is currently a public network. When you publish a feed, your feed configuration and metadata become publicly visible on the ATmosphere. This is inherent to the decentralized protocol and not something SkyFeed controls.

You are responsible for ensuring that your feeds and their content comply with applicable laws and Bluesky's community guidelines. We reserve the right to stop serving feeds through our infrastructure that violate these Terms or applicable law.

7. Acceptable Use

You agree not to use SkyFeed to:

• Violate any applicable laws or regulations
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of SkyFeed or its infrastructure
• Interfere with or disrupt the service or servers
• Create feeds designed primarily for harassment, abuse, or spreading harmful misinformation
• Use automated systems or bots to access the service without prior written consent
• Circumvent or abuse the subscription system or rate limits

8. Intellectual Property

SkyFeed is open-source software. The source code is available under its respective open-source license(s) on GitHub. These Terms do not restrict your rights under any applicable open-source license.

The SkyFeed name, logo, and branding are the property of Feedy UG (haftungsbeschränkt). The open-source license does not grant rights to use our trademarks.

9. Disclaimers

SkyFeed is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the service will be uninterrupted, error-free, or secure. Feed processing and delivery times may vary.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Feedy UG (haftungsbeschränkt) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claims related to the service shall not exceed the amount you paid for SkyFeed Pro in the 12 months preceding the claim. For free tier users, our total liability shall not exceed 50 EUR.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by applicable law.

11. Termination

You can delete your SkyFeed account at any time. Since your feed definitions live on the AT Protocol network (on your PDS), deleting your SkyFeed account removes only the data we hold on our side, such as authentication tokens and subscription status. Your feeds and AT Protocol identity are yours and remain under your control. If you have an active SkyFeed Pro subscription, please cancel it before deleting your account to avoid further charges.

We may suspend or terminate your access to SkyFeed if you materially violate these Terms or engage in conduct that is harmful to the service or other users. In such cases, we will:

• Notify you of the reason for suspension or termination
• Where the violation is remediable, give you a reasonable opportunity to address it before permanent termination

Termination means we stop serving your feeds through our infrastructure. We cannot delete your feed definitions from the AT Protocol network, as that data is controlled by your PDS. We will only terminate accounts without prior notice in cases where we are legally required to do so, or where continued access poses an immediate risk to the security of the service or safety of other users.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you at least 30 days before the updated Terms take effect, through the service or by other reasonable means. The notification will summarize the key changes and indicate the date they become effective.

If you do not agree with the updated Terms, you may stop using SkyFeed and delete your account before the changes take effect. If you have an active SkyFeed Pro subscription, you may cancel it and receive a pro-rated refund for the remaining period. We will not hold you to terms you have not had a fair opportunity to review.

13. Consumer Rights

If you are a consumer in the European Union, nothing in these Terms is intended to limit your mandatory rights under EU or national consumer protection law. In the event of any conflict between these Terms and mandatory consumer protection provisions, the consumer protection provisions shall prevail.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a competent court, the remaining provisions shall continue in full force and effect.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law provisions. If you are a consumer in the EU, you also retain the protection of mandatory provisions of the law of your country of residence.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we are willing to engage in good faith to resolve any disputes.
